  1. These premium rate competitions are offered to you by UKTV Media Limited. Our registered office is at 10 Hammersmith Grove, London, W6 7AP and our company registration number is 04266373 ("UKTV", "we" or "us").

Competition Entry

  1. These premium rate terms and conditions, together with any specific rules set out in the Competition Notices (defined below) apply to all premium rate competitions and prize draws (together referred to as the "Competitions") offered by us. Anyone who breaches them may be excluded from access to competitions.

  2. Please note that these terms and conditions apply to all Competitions that appear in UKTV airtime on our channels.

  3. The terms and conditions of any third party supplier may apply and must be accepted and complied with by the Competition winner. These shall include compliance with any health and safety regulations which apply whilst the Competition winner is taking part in any promotional activity (if applicable).

  4. As each Competition is different and operates in a different way, there will be some terms and conditions that apply only to the specific Competition and these will be set out in a notice included on the page for such Competition (the "Competition Notice") and are incorporated into these terms and conditions. The following general terms also apply. In the event of conflict between these terms and conditions and the Competition Notice, the Competition Notice shall prevail.

  5. You must be a UK resident to enter a Competition.

  6. All entrants must be over 18 years of age at the point of entry, unless otherwise stated. Employees (including family members) of UKTV or any prize provider are excluded from entering and their entry will not be considered.

  7. All entrants warrant by entering a Competition that all information submitted is true and UKTV reserves the right to verify any information provided.

  8. You may enter our Competitions in the following ways:

9.1 Text/ SMS entry

(i) You can enter our Competitions by text/SMS. Entrants are required to send a text to the short code or number as indicated in the Competition broadcast. Text entries will be charged at the standard network rate, which will vary depending on your mobile network provider (entrants should check this with their mobile network operator). When we receive a Competition entry, we (or our representatives) will send the entrant a text message acknowledging receipt of the Competition entry ("Acknowledgement Text"), the entrant will then be charged the premium rate cost stated in the Competition Notice. Charges will be deducted from the entrant's available credit time, if it is a pre-pay customer and if the entrant is a pay-monthly customer the charge will appear on its monthly bill. In the event an entrant has insufficient funds or credit to deliver the Acknowledgement Text, the entry will not be accepted. The entrant will not be eligible for a refund of the standard network rate charged by the entrant's mobile network provider in entering the Competition.

(ii) Subject to any Special Offer, detailed at paragraph 9.2 below, an entrant will only be permitted to submit a total of four (4) Competition entries from the same mobile phone number, any entries in excess of this number will not be counted and the Competition entrant may not be entitled to a refund.

(iii) Any SMS/text Competition entry received after the closing time set out in the Competition Notice will receive a free text from UKTV informing the entrant that (a) the entry was received late and will not be entered into the Competition and (b) it will not be entitled to a refund of the standard network rate charged by the entrant's mobile network provider on entering the Competition by text.

(iv) The Acknowledgement Text may also include information about UKTV, its channels or other services relating to the Competition. SMS/text entrants may opt out of receiving any marketing information in the confirmation message (please see paragraph 30 for further information).

(v) Competition entrants should always get the permission of the person who pays the bills before you use a phone to enter a Competition.

9.2 Special Offer Competition entry promotions

We may, from time to time, run a special offer associated with entering a Competition by SMS/text, such as a 'buy one get one free', '3 for 2' or '6 for 4' special offer ("Special Offer") and Competition entrants may take advantage of this, when available. Details of Special Offers will be set out in the Competition Notice, and, the following conditions shall also apply:

(i) Where, for example, a '3 for 2' Special Offer is available an entrant who submits a Competition entry by text will, together with the Acknowledgement Text, receive an invitation to enter the Competition via SMS a second time using the same mobile telephone number and advising that where they do, they will receive an additional (i.e. a third) entry into the Competition without charge (providing paragraph 9.1(ii) above does not apply and the entrant has not already submitted more than the permitted number of Competition entries). Entrants who then, using the telephone number used for the original message, send a second SMS text with their answer (where applicable) to the premium rate SMS short code stipulated before the Competition closing date and time will be entered into the relevant draw a second and third time for a chance to win the prize but will be charged for only two entries.

(ii) Where an entrant is required to answer a question to enter a Competition, the same answer submitted by the SMS entry on the first or second or fourth entry (depending on the Special Offer), will be submitted for the resulting free entry (i.e. the second or third or fifth and sixth entry respectively).

(iii) If a free SMS entry is randomly drawn as a winner, it will only be valid if one or two or four (as applicable) charged entries have been registered as paid by the entrant and none of those entries qualified the entrant for any other free entry, taking into account the sequence in which the paid entries were received and any other free entry was awarded.

(iv) Entries over the maximum number of entries, set out in paragraph 9.1(ii) above, from the same originating telephone number will not be entered into the Competition.

9.3 Postal Entry

(i) You may unless notified otherwise in any particular Competition, enter a Competition by post by sending your answer, name and telephone number (or such other contact details requested) written clearly to the postal address as indicated in the Competition broadcast.

(ii) Only one entry will be accepted per postage stamp.

(iii) Entries sent by post must reach us by the closing date and time specified in the Competition Notice.

  1. All premium rate Competition entries must be received within the competition period indicated in the Competition Notice. Any entries received before or after this period will not be entered into the Competition. Entries delayed by postal strike or for any other reason which are not received within the competition period may not be valid.

  2. You can enter a premium rate Competition via the postal entry method as many times as you wish unless otherwise stated in the Competition Notice.

  3. Any entries which are incomplete, incorrect, incomprehensible or not received by UKTV will be void. We also reserve the right to disqualify entrants and/or offer the prize to another winner if we believe, or have grounds to believe an entrant has evaded any charges associated with entering the Competition, or in respect of postal entries, has failed to pay and/or affix the correct postal charges. Any further entrant will be selected on the same criteria as the original entrant and will be subject to these terms and conditions.

  4. Please note UKTV will not accept proof that a Competition entry was sent as proof that the entry was received by UKTV.

Winner Selection and Prizes

  1. Winners are selected at random from all entries received by the stated closing date in the Competition Notice by a closed computer generated system and then confirmed as correct and eligible. We will have the final overall decision over winner selection and this decision is final. No correspondence will be entered into.

  2. All correct entries have an equal chance of selection regardless of method of entry.

  3. UKTV or its representative (Spoke (Interactive) Limited) will attempt to contact the winner within 28 days after the closing date of the Competition via the email address, telephone number or postal address provided by the winner when entering the Competition. The winner will have a specified period of time within which to claim the prize, which will be set out in the Competition Notice. UKTV will attempt to contact you up to nine times within this specified period. If UKTV is unable to notify the winner or you do not respond within the stated time period and/or the winner fails to provide an address for delivery of the prize, you may forfeit your prize and UKTV reserves the right to award the prize to another winner in accordance with these terms and conditions.

  4. The winner should allow 28 days for delivery of the prize from the date the winner successfully claims the prize.

  5. UKTV will not be liable if any prize fails to reach the winner or cannot be taken for reasons beyond our control, or if any prize is damaged during delivery.

  6. UKTV may pass a Competition winner's details to a third party for the purpose of fulfilling the prize. The prize winner will be required to comply with any instructions given by the third party in relation to the prize, including without limitation complying with any timeframes provided, providing information requested and paying any costs not included in the prize. UKTV will not be liable and does not accept responsibility if a prize winner does not comply with these instructions which may result in a prize being forfeited.

  7. Prizes are awarded at UKTV's discretion and no prizes will be awarded as a result of improper actions by or on behalf of an entrant, which includes without limitation breach of these terms and conditions, the making of automated bulk entries, fraud and dishonesty.

  8. No alternative prize will be given and the prize is non-transferable and non-exchangeable. However, we reserve the right to change the prize due to circumstances beyond our control or to offer an alternative of similar value.

  9. It is the prize winner's responsibility to pay any and all applicable taxes on prizes.

  10. UKTV reserves the right to verify your eligibility and to check your identity. If you have been asked for proof of your identity and/ or your eligibility, your failure to provide such proof within a reasonable time could result in your disqualification from a Competition or the withdrawal of any prize. All personal details and information you supply must be truthful and accurate.

  11. We reserve the right to disqualify you from the Competition and/ or withdraw any prize if you at any stage supply any untruthful, inaccurate or misleading personal details and information or if we consider you have breached these terms and conditions or the rules contained in the Competition Notice.

  12. If an entrant is disqualified from a Competition, it will be at our discretion to decide whether a replacement will be selected. If we decide to select a replacement, the replacement will be chosen using the same selection procedure as the original entrant and will be subject to these terms and conditions.

  13. Travel, accommodation, expenses, charges and travel insurance are not included as part of any prize unless we tell you otherwise. We strongly recommend you purchase insurance for all activity prizes.

  14. If a prize involves foreign travel please ensure that you hold a full and valid passport. UKTV will not be liable for a Competition winner's failure to travel due to having an invalid passport or other necessary travel documentation and/or visas.

  15. In the event of any dispute regarding these terms and conditions, the Competition Notice, conduct, results or any fault, misunderstanding, mistake or dispute concerning the operation of a premium rate competition, including the correctness or acceptability of any answers given by winners, or the operation of any technical/communications system, UKTV's decision shall be final.

Marketing and Publicity

  1. All Competition entrants agree that if they win a Competition they will allow UKTV to use their name and picture, without separate consent, in marketing and publicity undertaken by UKTV (or a third party on our behalf) which may be in more than one country and which may be in a number of media, for example, print, television, internet. We will pay your reasonable expenses if we need you to make yourself available to be used in marketing and publicity of this sort.

  2. A Competition entrant, who submits its entry via text/SMS, may opt out of receiving marketing information from UKTV by adding the words NO INFO after the competition entry or answer. Please note that in entering a competition by text/SMS an entrant is indicating that it consents to receiving marketing information from UKTV in relation to similar products via text/SMS. You may opt out of receiving marketing information at any time by texting STOP to one of our Competition entry short codes, this text will cost one standard network rate message.

Data Protection

  1. UKTV will only use personal data provided by Competition entrants to operate the Competition that you are taking part in. Where we or other companies in our corporate group want to use your personal details for other purposes (such as marketing) we will offer you the opportunity to agree or to refuse this (please see paragraph 30 above for further details).

  2. A Competition entrants' personal data will be treated in accordance with our Privacy Policy from time to time and in accordance with UK data protection legislation. Further information is found in UKTV's Privacy Policy (for those requesting a copy of these Terms and Conditions by post, you will also be sent a copy of the Privacy Policy).

  3. Competition entrants' personal data may also be provided to their mobile phone operator or a relevant regulatory body (e.g. PayPhonePlus) or the police in the course of their investigations of any complaints and/or suspected unlawful activity.

Liability

  1. Nothing in these terms and conditions removes or limits UKTV's liability for fraud, for death or personal injury caused by our negligence or for any liability which cannot be limited or excluded by the law.

  2. These terms and conditions do not affect the rights that are granted to an entrant as a consumer by the law. Otherwise, UKTV excludes all liability, to the fullest extent permitted by law, in respect of the premium rate competitions offered by us.

  3. UKTV will not be liable and does not accept responsibility to you if you suffer loss or inconvenience because of the failures of persons or systems that we do not directly control - for example, mobile phone network operators, internet service providers, software providers and telephone traffic handlers.

  4. UKTV reserves the right to cancel a Competition without notice, at its sole discretion, if it believes the Competition is not capable of being conducted as set out in these terms and conditions or in the event of a virus or human error or any circumstance beyond UKTV's control.

Law and Jurisdiction

  1. These terms and conditions form a legally binding agreement between you and us. We reserve the right to change them and update them from time to time but if we do so we will post the changes on this website.

  2. These terms and conditions shall be governed by the laws of England and Wales and are subject to the exclusive jurisdiction of the courts of England and Wales.
